Acceptance of an inheritance by a person with a disability is possible, unless it requires support measures by the court.
These measures may consist of:
1) Guardianship, which can be representative or non-representative. In the first case, the inheritance will be accepted by the guardian, but the guardian will need court authorisation to accept without benefit of inventory any inheritance or to reject it. If the guardianship is non-representative, it will depend on what the judicial authority determines as to the need for the guardian's assistance.
2) The de facto guardian, for the acts mentioned in Article 287 of the Civil Code, including acceptance without benefit of inventory.
Finally, consideration should be given to the actions of the legal guardian, which is foreseen for cases in which there is a conflict of interests between the represented party and his/her representative or guardian, or when the latter are unable to perform their functions.
